Terms of Service

1. Acceptance of Terms

By accessing or using QUIZZERA ("the Platform"), operated by MENTISERA (SMC-Private) Limited ("the Company", "we", "our", or "us"), a company incorporated under the laws of Pakistan, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all visitors, registered users, mentors, content editors, and any other users.

2. Eligibility

You must be at least 13 years old to use QUIZZERA. By creating an account, you represent that you meet this requirement. Users under 18 should review these terms with a parent or guardian.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate information when registering and keep it up to date.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at hello@quizzera.pk if you suspect unauthorised access.
• One account per person — creating multiple accounts to circumvent restrictions is not allowed.
• Academic Integrity: You must maintain absolute academic integrity. Creating accounts or using the Platform to cheat, share mock exam content unauthorizedly, bypass proctoring or security systems, or facilitate academic dishonesty is strictly prohibited and will result in immediate termination without refund.

4. Acceptable Use

You agree not to:

• Share, resell, or redistribute paid content, mock tests, or MCQ answers outside the Platform.
• Use automated tools (bots, scrapers, crawlers) to extract MCQ content, answers, or any platform data.
• Attempt to reverse-engineer, hack, decompile, or disrupt the Platform or its infrastructure.
• Bypass, disable, or interfere with any security, proctoring, or academic integrity verification mechanisms used during practice exams or drills.
• Post or share content that is abusive, defamatory, or in violation of any applicable law.
• Impersonate any person, mentor, or QUIZZERA representative.
• Use QUIZZERA for any commercial purpose without prior written consent.

5. Subscription, Billing, and Cancellation

• Free tier access is provided as-is with no guarantees of continued availability.
• Paid subscriptions are billed on a recurring basis (monthly or annually) and renew automatically at the end of each billing cycle unless you cancel your subscription through your account settings or by contacting us at hello@quizzera.pk before the renewal date.
• Upon cancellation, your subscription will remain active until the end of the current paid billing period, after which access to premium content will cease.
• Prices may change with 30 days' notice to subscribers.
• Refund requests are reviewed under our Refund Policy and applicable law.
• All payments are processed securely by our payment provider (Switch Payment Gateway). We do not store credit card or raw payment details on our servers.

6. Mentor Sessions

• Booking a mentor session creates a direct service agreement between you and the mentor.
• Cancellations must be made at least 24 hours before the scheduled session to receive a full credit.
• QUIZZERA is not responsible for the content or outcome of individual mentor sessions, though we do quality-screen mentors.
• Do not share personal contact information with mentors outside the Platform until after a session is confirmed.

7. Intellectual Property

All content on QUIZZERA — including MCQs, explanations, course material, MENTIS responses, design, and software — is owned by MENTISERA (SMC-Private) Limited or its licensors. You may not copy, reproduce, or distribute any content without express written permission.

User-generated content (e.g., forum posts, submitted questions) grants QUIZZERA a non-exclusive licence to use, display, and distribute that content on the Platform.

8. AI Features (MENTIS) & Disclaimers

QUIZZERA incorporates MENTIS, an advanced artificial intelligence-powered study assistant. You acknowledge and agree that:

• MENTIS is a machine learning agent designed solely as a study aid. Responses are generated dynamically and may occasionally contain inaccuracies, errors, or hallucinations.
• All AI responses are provided for informational and educational purposes only. They do not constitute official academic, medical, legal, financial, or professional advice.
• You are solely responsible for verifying any answers, explanations, or data provided by MENTIS using official exam materials, textbooks, or qualified educators before relying on them.
• The Company accepts no liability or responsibility for any actions taken, exams failed, or decisions made based on the information provided by MENTIS.

9. Disclaimers

QUIZZERA is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, secure, error-free, or that the results obtained from using the Platform (including study suggestions, predictions, and recommendations) will guarantee success in any official exams. Exam success depends on individual effort and external factors beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, MENTISERA (SMC-Private) Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount paid by you to QUIZZERA in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, at our discretion and without prior notice. You may delete your account at any time from your account settings. Upon termination, your access to paid content ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Platform. Continued use of QUIZZERA after changes take effect constitutes acceptance of the new Terms.

13. Governing Law & Dispute Resolution

These Terms of Service and any disputes arising from or relating to your use of the Platform shall be governed by and construed in accordance with the laws of Pakistan. Any legal actions, suits, or proceedings arising out of these Terms shall be resolved exclusively in the courts of Lahore, Punjab, Pakistan.
